Welcome to Via My VA. These Terms of Service ("Terms") govern your access to and use of the web application available at viamyva.com (the "Service"), operated by Via My VA ("we," "our," or "us").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Use of the Service
The Service is a productivity and project management tool. You may use it only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable federal, state, or local law
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Interfere with or disrupt the integrity or performance of the Service
- Upload or transmit any content that is harmful, offensive, or infringes on the rights of others
- Use the Service to store or transmit malicious code
2. Accounts and Access
Access to the Service requires signing in with a Google account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to notify us immediately at viamyva@gmail.com if you become aware of any unauthorized use of your account.
We reserve the right to suspend or terminate access for any user who violates these Terms or who we determine, in our sole discretion, is using the Service in a harmful or abusive manner.
3. Your Content
You retain ownership of all content you create, upload, or store within the Service ("Your Content"). By using the Service, you grant us a limited license to store, display, and process Your Content solely for the purpose of providing the Service to you.
You are solely responsible for Your Content. We do not review, endorse, or take responsibility for any content created by users.
4. Google Drive Integration
The Service offers optional integration with Google Drive. By authorizing this integration, you grant the Service permission to access your Google Drive files as needed to provide the features you use. You may revoke this permission at any time through your Google Account settings. Revoking access may limit certain features of the Service.
5. Intellectual Property
All elements of the Service — including the design, code, branding, and content created by us — are owned by Via My VA and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our express written permission.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand our data practices.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
8. Limitation of Liability
To the fullest extent permitted by law, Via My VA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
9. Indemnification
You agree to indemnify and hold harmless Via My VA and its operators from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.
10. Modifications to the Service or Terms
We reserve the right to modify or discontinue the Service, or to update these Terms, at any time. We will indicate changes by updating the "Last Updated" date at the top of this page. Continued use of the Service after any changes constitutes your acceptance of the new Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New York, and you consent to the personal jurisdiction of such courts.
12. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Via My VA regarding your use of the Service and supersede any prior agreements.
